Securities Fraud
Litigation
At PDK, we represent individual
investors, pension plans and corporations in arbitrations
and lawsuits against stockbrokers, financial advisors, insurance
agents and pension plan fiduciaries. We have recovered millions
for our clients who have suffered losses caused by violations
of securities laws, insurance laws, laws governing the financial
services industry and ERISA. If you have lost money because
of the conduct of your stockbroker, financial advisor, insurance
agent or pension plan advisor, please contact us for a free
evaluation.
In considering legal representation, it is
vital to select an attorney that has experience in securities
litigation. Because most claims against stockbrokers are arbitrated
before either the National Association of Securities Dealers
or the New York Stock Exchange, it is important for victims
of investment fraud to hire attorneys with arbitration experience.
PDK has represented investors in numerous arbitration cases.
The attorneys who practice securities litigation at PDK are
members of the Public Investors Arbitration Bar Association
(PIABA). In addition, securities fraud attorneys at PDK have
experience serving as arbitrators and/or mediators. PDK also
is experienced in representing investors in traditional lawsuits,
including pension plan and ERISA litigation in federal court.
If you believe that you have lost money due to the conduct
of a stockbroker, financial advisor, insurance agent or pension
plan fiduciary or are concerned about possible warning signs,
contact PDK for a free evaluation. We will review the facts
of your case and determine whether you have a claim.
Set forth below are some examples of the type
of conduct and practices the securities fraud lawyers at PDK
have encountered when handling claims against stockbrokers,
financial advisors, insurance agents and pension plan fiduciaries.
- Churning (improper and excessive buying
and selling of securities)
- Switching (switching is similar to churning
and involves a broker or financial advisor moving money
between annuities or mutual funds for the purpose of generating
commissions)
- Twisting (an illegal practice used by insurance
agents to sell additional or new life insurance in order
to generate commissions)
- Unsuitability of investments given the
particular needs of the investor
- Misrepresentation, fraud and omission
- Breach of fiduciary duty, conflict of interest
and embezzlement
- ERISA violations and pension abuse
- Unauthorized trading and failure to execute
or follow instructions
- Price manipulation
- Malpractice and negligence
- Margin abuse
If you believe that you have lost money
as a result of any of the above illicit practices, or otherwise
feel that you have lost money at the hands of a stockbroker,
financial advisor, insurance agent or pension plan fiduciary,
please contact
our securities fraud lawyers for a free evaluation.

Business Litigation
Large corporations, small businesses
and individuals hire PDK to represent them in a very broad
range of business and commercial litigation matters. For example,
in the past year PDK has handled cases ranging from representing
a regional bank in a lender liability action to representing
a condominium association in an arbitration with the owner
of the condominium building. In the past year, PDK has advised
several corporations regarding potential litigation with minority
shareholders. Contractors and builders have retained PDK in
a variety of construction disputes. Business litigation cases
we typically handle include: Business Torts, Contract Disputes,
Shareholder Disputes and Business Dissolutions, Unfair Competition,
Theft and Diversion of Business and Trade Secrets.

Employment Litigation
The lawyers at PDK have extensive experience
representing employers and employees in employment disputes
before federal and state administrative agencies and in federal
and state courts. We represent clients in regulatory agency
investigations, counsel employers on compliance issues and
defend employers from lawsuits. We have also represented individuals
in claims brought under Title VII, the ADEA, the ADA and the
FMLA.
PDK represents employers before federal and
state administrative agencies, including the EEOC, the Department
of Labor, the Maryland Commission on Human Relations and local
enforcement agencies.
Although our firm is primarily a litigation boutique, we have
numerous clients that regularly turn to us for advice on compliance
with the labyrinth of federal, state and local laws affecting
employers. Our clients recognize that not only can we advise
them regarding the employment laws, but also that we are uniquely
qualified to counsel them regarding how employment issues
will be resolved in the courts and before juries. Our relationship
with our clients and the advice we give enables them to reduce
the likelihood of costly employment claims.

Insurance Claims & Coverage Litigation
Coverage litigation involves disputes over whether specific claims are covered under an insurance policy. As well as insurance companies, PDK has represented partnerships, corporations and individuals in insurance disputes. In fact, one of the leading insurance coverage cases in Maryland, Aetna Insurance v. Aaron, was handled by attorneys from PDK. In that case, Brian Parker was not only able to establish that insurance coverage existed for a substantial disputed claim, he also was successful in forcing the insurance company to pay all of the costs and expenses his client incurred in the case, including attorney's fees.

Professional
Malpractice - Legal & Medical
Legal Malpractice
At PDK we believe that lawyers should be held to the same standards as other professionals. Although many law firms are reluctant to file lawsuits against other lawyers who have failed to properly represent their clients, we believe lawyers should be held accountable for their negligence. We have represented both individuals and businesses in lawsuits against attorneys who have failed to live up to the standards that their clients deserve, or who have violated the ethical rules that govern the legal profession. If you believe that your attorney has failed to properly represent you, or are concerned about the level of representation you received, contact PDK in Baltimore, Maryland, for a free evaluation.

Medical Malpractice
Parker, Dumler & Kiely LLP represents victims of medical malpractice. PDK prosecutes medical malpractice and medical negligence cases against doctors, hospitals and other health care providers in Maryland and the District of Columbia.
Our attorneys have obtained substantial recoveries for victims of medical malpractice.
Medical malpractice claims are factually and legally complex. For example, in Maryland, there are substantial procedural differences between medical malpractice cases and ordinary lawsuits. Similarly, the factual issues presented by medical malpractice cases are often very complicated and require thorough investigation. The Maryland medical malpractice attorneys at PDK have extensive experience litigating complex cases, and bring that experience to every medical malpractice case that they prosecute. At PDK we also strive to obtain highly credentialed experts on behalf of our clients.
Because of the complexity of medical malpractice cases, they are both expensive and time-consuming. At PDK, we understand that the hardships placed upon our clients by medical malpractice often leave them in a difficult financial situation. At PDK in Baltimore, Maryland, we provide free consultations regarding potential medical malpractice claims. Similarly, when we accept the responsibility of prosecuting a client's medical malpractice claim, we routinely advance the costs of pursuing the case to conclusion. If there is no recovery, the client pays nothing.

Asbestos/Mesothelioma
Mesothelioma is a rare cancer
that attacks the lining of the lungs, abdomen or heart. It
is caused by exposure to asbestos. Mesothelioma can strike
people who have been exposed to small amounts of asbestos
for even short periods of time. In most cases, mesothelioma
does not develop until 20 to 50 years after the exposure to
asbestos.
At PDK, we carefully investigate all
of our clients' histories to find every possible exposure
to asbestos and to aggressively pursuing the companies that
are responsible for our clients' mesothelioma. If you have
been diagnosed with mesothelioma, please contact
